This privacy policy (the “Privacy Policy”) describes (i) the information that DynaSis Integrated Systems Corporation (“DynaSis,” “our,” “us” and “we”), the provider of the Site, collects from visitors to the www.DynaSis.com Web site and such other web sites as we may operate from time to time (the “Site”) and otherwise from DynaSis’ customers and prospective customers (“you” or “your”), (ii) what we do with that information, and (iii) how you can update and control the use of that information. This Site is for commercial use only and does not offer products or services that are to be used primarily for personal, family or household purposes. As used in this Privacy Policy, the terms “you” and “your” include the individual using the Site, the business in whose name the individual requests information from us, and the business in whose name the individual registers to use the Site.

You should note that DynaSis offers products and services only in certain of the 48 contiguous states of the United States and DynaSis does not solicit business from businesses located elsewhere. Persons located outside the 48 contiguous states of the United States should not submit information to DynaSis as DynaSis is under no obligation of any kind with respect to such information and such information will not be subject to this Privacy Policy.

Your use of the Site or DynaSis’ services will constitute your: (i) acknowledgment of this Privacy Policy, and (ii) agreement to abide and be bound by this Privacy Policy. We reserve the right to change this Privacy Policy at any time. Such changes, modifications, additions or deletions will be effective immediately upon notice thereof by posting the revised Privacy Policy on this page and by such additional means, if any, that we may determine are appropriate. Each individual using the Site or DynaSis’ products or services by doing so represents and warrants to DynaSis that (i) he or she has the authority to bind his or her business to the terms and conditions of this Privacy Policy. You acknowledge and agree that it is your responsibility to review the Site and this Privacy Policy periodically and to be aware of any changes. Your continued use of the Site or DynaSis’ products and services after such change will constitute your: (i) acknowledgment of the changed Privacy Policy, and (ii) agreement to abide and be bound by the modified Privacy Policy. Unless we indicate otherwise, our current Privacy Policy applies to all information that we have collected from you.
This Privacy Policy addresses only the use and disclosure of information we collect from you. Web sites of our affiliates and other third parties that are accessible through our Site have their own privacy policies and data collection, use and disclosure practices. Please consult each site’s privacy policy. We are not responsible for the policies or practices of third parties or our affiliates.

This Site is not intended for persons under 13 years of age. We do not knowingly solicit or collect personal information from or about children, and we do not knowingly market our products or services to children.

Certain information relating to your use of our products and services commonly referred to as “customer proprietary network information” or “CPNI,” may be subject to certain federal and state CPNI laws and regulations. We are fully committed to comply with these CPNI laws and regulations. To the extent that an applicable federal or state CPNI law or regulation would restrict our use or disclosure of Collected Information in a manner that would otherwise be permitted under this Privacy Policy, then DynaSis will limit the use and disclosure of such Collected Information to the extent necessary to comply with the applicable federal and state CPNI laws and regulations.

The following are questions and answers that further explain our privacy practices for information that we collect from you.

1. What types of information do we collect?

In order to better provide you with our various products and services, we collect two types of information from you: Personally Identifiable Information and Non-Personally Identifiable Information, as each term is further defined below. Personally Identifiable Information and Non-Personally Identifiable Information are collectively referred to in this Privacy Policy as the “Collected Information.” Our primary goal in obtaining Collected Information from you is to provide you with a smooth, efficient, and customized experience while using our Site and to facilitate our delivery of products and services to you.

Personally Identifiable Information: This refers to information that specifically identifies you or your business and that you have provided to us. When you engage in certain activities on the Site or otherwise contact us, we may request that you submit Personally Identifiable Information to us. Examples of when this may occur include, but are not limited to, when you submit information to us from the “contact me now” or the “how do I order” pages of the Site and when you register to use or use the Site. Examples of the Personally Identifiable Information that you could provide to us include, but are not limited to, your first and last name, company name, mailing address, email address, telephone numbers, facsimile numbers, credit card information and bank account information such as bank routing number and checking account number. Depending upon the activity, some of the information that we ask you to provide is identified as required in order for us to provide our products and services to you and some as voluntary. If you do not provide the required data with respect to a particular activity, you will not be able to engage in that activity.

Non-Personally Identifiable Information: This refers to information that does not specifically identify you or your business and that you have provided to us or that we collected from your use of the Site. We collect certain information from you based upon your use of the Site in several ways. This information is compiled and analyzed on both an individual and an aggregated basis. This information may include the Uniform Resource Locator (“URL”) of the Web site that you came from immediately prior to visiting the Site, the pages of the Site that you have viewed, the average time spent on each page, the number of visits that you have made to the Site, what browser you are using, and your Internet Protocol (“IP”) address. A URL is the global address of documents and other resources on the Web. An IP address is an identifier for a computer or device on a Transmission Control Protocol/Internet Protocol (“TCP/IP”) network. Networks like the Internet use the TCP/IP protocol to route information based on the IP address of the destination. In other words, an IP address is a number that is automatically assigned to your computer whenever you are surfing the Web, allowing Web servers to locate and identify your computer. Computers require IP addresses in order for users to communicate via the Internet.

2. How do we collect information from you?

We do not collect any Personally Identifiable Information from you unless you voluntarily provide it to us. In addition, we may also collect, or our content server may collect, certain Non-Personally Identifiable Information through your use of the Site.

3. Does DynaSis use cookies on the Site?

Yes. Cookies are small pieces of data stored by your Internet browser on your computer’s hard drive that can later be retrieved to identify you to us. When you browse the Site, a cookie is installed on your computer that may be used to enable us to gather Non-Personally Identifiable Information such as your IP address that you use to access the Site and the URL you came from immediately prior to visiting the Site. If you decide to submit Personally Identifiable Information to us through the Site, then DynaSis may relate such information to the Non-Personally Identifiable Information that we collect. In this case, we use cookies to recognize you on subsequent visits and make your online experience more convenient. We do not use cookies to obtain data from your hard drive, obtain your e-mail address, or obtain Personally Identifiable Information.

4. How does DynaSis use Collected Information?

We use Collected Information only in the following ways and as described in Section 5 below:

We primarily use Collected Information to (i) provide you with products and services you have requested, (ii) service your account, (iii) develop and improve our products and services, and (iv) enable us to fulfill our obligations to sales agents (if applicable) including the reporting and validation of commissions owed.

Subject to the opt out procedures described in Section 6 below, we may use Collected Information to inform you of additional products and services of DynaSis, its affiliates and third parties that may be of interest to you.
We may use Collected Information to (i) measure the number of visits, average time spent, page views, and other statistics to monitor how the Site is being used, (ii) monitor the Site’s performance, (iii) make the Site easier and more convenient for you to use, (iv) prepare aggregate, non-identifying, information for use in marketing, side advertising, or similar activities, and (v) resolve disputes, troubleshoot problems and enforce our agreements with you.

5. With whom does DynaSis share Collected Information?

We do not disclose Personally Identifiable Information to others except as described in this Section 5 and under no circumstances will we disclose Personally Identifiable Information to others to market their products and services to you.

Since we provide some of our products and services through arrangements with service providers, affiliates, partners and other third parties, we may share Collected Information with these parties to:
  • Enable and enhance our ability to provide our products and services to you;
  • Enable those parties to perform services on our behalf such as mailing, transaction processing and other services in connection with the products and services that we provide to you; and
  • Enable us to fulfill our obligations to sales agents (if applicable) including the reporting and validation of commissions owed.
For example, we may release your credit card information to the card-issuing bank or a third party transaction service provider to receive payment for the products and services that we provided to you.

Because our products and services are for businesses only, all information relating to you and/or the products and services you obtain or access, including without limitation, account information and purchases you make on any account, your registration information, and your balance and payment information, may be shared with the business in whose name you request information from us and the business in whose name you register to use the Site. You should have no expectation that this information will remain private from the business.
We may also aggregate Non-Personally Identifiable Information with the Non-Personally Identifiable Information of our other customers and share such aggregated data with third parties in a manner that does not identify you as the source of any specific item of data within the aggregated data.

Occasionally, we may be required by law enforcement or judicial authorities or other legal process to provide Collected Information. We will disclose Collected Information upon receipt of a court order, subpoena, or to cooperate with a law enforcement or comply with legal process. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.

If all or part of our business is sold, merged or otherwise transferred to another entity, Collected Information may be transferred as part of that transaction. In connection with a proposed sale, merger or other transfer of all or a portion of our business, we may disclose Collected Information to a potential acquirer of all or part of our business as part of the review of our business, subject to the potential acquirer agreeing to maintain the Collected Information according to customary confidentiality obligations.

6. What are your choices regarding our collection and use of Collected Information?
Occasionally, we may contact you regarding products and services of DynaSis, its affiliates and third parties that we believe may be of interest to you based on the Collected Information that we have collected from you. You may opt out of receiving these solicitations by opting out when you order service through the Site or by writing, faxing or emailing us with this request at the address, fax number or email address, respectively, indicated on the “Contact DynaSis” page accessible through the “meet DynaSis” link on the home page of the Site. If you have previously notified us about your preference not to receive these solicitations, it is not necessary to do so again unless you change your preferences. Your request should include your name, address, telephone number and account numbers and should not be sent with any other correspondence. In order to process your request, we require that the request be provided by you directly and not through a third party. We will honor your request within a reasonable period of time, but in no event later than the time period required by law, if any. You may continue to receive marketing offers that were already in production prior to the processing of your request.

You may set your browser to notify you when your computer receives a cookie or to prevent cookies from being received by your computer. Please note, however, that by not accepting cookies, you will limit the functionality that we can provide you when you visit the Site. 7. How can you access, correct and update your Personally Identifiable Information?

We believe you should have the ability to access and edit Personally Identifiable Information. You may contact us by phone, fax, or email according to the contact information on the “Contact DynaSis” page accessible on the home page of the Site to request access to your Personally Identifiable Information. Additionally, you may access and update your account information with us (e.g., address, email address, and telephone number) by logging into the Site. We encourage you to promptly update your Personally Identifiable Information if it changes. We maintain your Personally Identifiable Information for a length of time appropriate to our business needs.

8. How is Personally Identifiable Information secured and protected?

We have taken measures designed to protect the Personally Identifiable Information that you send to us through the Site by using a security protocol known as Secure Socket Layer (SSL), which encrypts this information to help prevent unauthorized parties from reading this information. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your Personally Identifiable Information, you acknowledge that: (i) there are security and privacy limitations of the Internet which are beyond our control; (ii) the security, integrity and privacy of any and all information and data exchanged between you and us through the Site cannot be guaranteed; and (iii) any such information and data may be viewed or tampered with in transit by a third party. We have security measures in place to allow only the appropriate personnel of DynaSis, our affiliates, and our service providers to access to your Personally Identifiable Information. Persons who we allow to access your Personally Identifiable Information are required to protect this information according to customary confidentiality obligations. E-mail messages that you send to DynaSis may not be secure when they are transmitted to DynaSis. If your communication is of a sensitive or confidential nature, then you may choose to send it to DynaSis by fax or regular mail instead at the fax number or address, respectively, indicated on the “Contact DynaSis” page accessible through the “meet DynaSis” link on the home page of the Site.
